These Terms of Service ("Terms") govern your use of the unmask iOS application (the "App") and the website at getunmask.org (the "Website"), operated by ("we", "us", or "our").

By downloading, installing, or using the App you agree to these Terms. If you do not agree, do not use the App.

1. About the App

unmask is a conversation and connection app that lets users answer open-ended questions and play "This or That" rounds with friends, partners, and family. The App is currently in beta - features may change, and we do not guarantee uninterrupted availability.

2. Eligibility

You must be at least 13 years old to use the App (or 16 in the European Union). By using the App you confirm that you meet this requirement. If you are under 18, you confirm that you have your parent or guardian's permission.

3. Accounts

You may use certain features (Table Mode) without an account. To save answers and access Answer Mode you must create an account using Sign in with Apple or a magic link email.

• You are responsible for maintaining the security of your account.
• You must provide accurate information when creating your account.
• You may not share your account with others or create accounts on behalf of someone else without their consent.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

You may submit text answers and choose display names within the App ("User Content").

• You retain ownership of your User Content.
• By submitting User Content, you grant us a limited, non-exclusive licence to store and display it to you within the App.
• You must not submit content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• We do not review User Content proactively but reserve the right to remove content that violates these Terms.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorised access to our systems or another user's account.
• Reverse-engineer, decompile, or disassemble the App.
• Use automated tools (bots, scrapers) to access the App or its content.
• Impersonate any person or entity.
• Transmit viruses, malware, or any other harmful code.
• Interfere with the App's operation or servers.

6. Beta Programme

The App is currently in beta. This means:

• Features may be incomplete, changed, or removed at any time without notice.
• The App may experience downtime, data loss, or other issues.
• We may collect additional feedback and usage data to improve the App.
• Access to the beta may be revoked at any time at our sole discretion.

We strongly recommend that you do not rely on the App for any critical purpose during the beta phase.

7. Intellectual Property

All content, trademarks, design elements, and code within the App and Website - excluding User Content - are owned by or licensed to us. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be error-free or continuously available.

10. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability to you for any claim shall not exceed €50.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability; in those jurisdictions our liability is limited to the greatest extent permitted by law.

11. Termination

We may suspend or terminate your access to the App at any time, with or without cause. You may stop using the App at any time and request account deletion via Settings → Delete Account or by emailing hey@getunmask.org.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the App or by email. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of , without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of , unless mandatory consumer protection laws in your country require otherwise.

Diese Allgemeinen Geschäftsbedingungen („AGB") regeln die Nutzung der unmask iOS-App (die „App") und der Website getunmask.org (die „Website"), betrieben von („wir", „uns" oder „unser").

Mit dem Herunterladen, Installieren oder Verwenden der App stimmst du diesen AGB zu. Wenn du nicht zustimmst, nutze die App bitte nicht.

1. Über die App

unmask ist eine Gesprächs- und Verbindungs-App, mit der Nutzerinnen und Nutzer offene Fragen beantworten und „This or That"-Runden mit Freundinnen und Freunden, Partnerinnen und Partnern sowie Familienmitgliedern spielen können. Die App befindet sich derzeit in der Beta-Phase - Funktionen können sich ändern, und wir garantieren keine ununterbrochene Verfügbarkeit.

2. Voraussetzungen

Zur Nutzung der App musst du mindestens 13 Jahre alt sein (bzw. 16 Jahre in der Europäischen Union). Mit der Nutzung der App bestätigst du, dass du diese Voraussetzung erfüllst. Wenn du unter 18 Jahre alt bist, bestätigst du, dass du die Erlaubnis deines Erziehungsberechtigten hast.

3. Nutzerkonto

Bestimmte Funktionen (Table Mode) kannst du ohne Konto nutzen. Um Antworten zu speichern und den Answer Mode zu verwenden, musst du ein Konto erstellen - per „Sign in with Apple" oder Magic Link per E-Mail.

• Du bist für die Sicherheit deines Kontos verantwortlich.
• Bei der Kontoerstellung musst du korrekte Angaben machen.
• Du darfst dein Konto nicht mit anderen teilen und keine Konten im Namen anderer ohne deren Zustimmung erstellen.
• Wir behalten uns das Recht vor, Konten, die gegen diese AGB verstoßen, zu sperren oder zu löschen.

4. Nutzerinhalte

Du kannst in der App Textantworten eingeben und Anzeigenamen wählen („Nutzerinhalte").

• Du behältst das Eigentum an deinen Nutzerinhalten.
• Mit der Übermittlung von Nutzerinhalten räumst du uns eine eingeschränkte, nicht-exklusive Lizenz ein, diese innerhalb der App zu speichern und dir anzuzeigen.
• Du darfst keine Inhalte übermitteln, die rechtswidrig, schädlich, bedrohend, beleidigend, verleumderisch oder anderweitig anstößig sind.
• Wir überprüfen Nutzerinhalte nicht proaktiv, behalten uns jedoch das Recht vor, Inhalte zu entfernen, die gegen diese AGB verstoßen.

5. Zulässige Nutzung

Du verpflichtest dich, Folgendes zu unterlassen:

• Nutzung der App für rechtswidrige Zwecke oder unter Verstoß gegen anwendbare Gesetze oder Vorschriften.
• Versuche, unbefugten Zugang zu unseren Systemen oder Konten anderer Nutzerinnen und Nutzer zu erlangen.
• Reverse Engineering, Dekompilierung oder Disassemblierung der App.
• Einsatz automatisierter Tools (Bots, Scraper) zum Zugriff auf die App oder deren Inhalte.
• Identitätsvortäuschung gegenüber Personen oder Unternehmen.
• Übertragung von Viren, Malware oder anderen schädlichen Codes.
• Störung des Betriebs der App oder ihrer Server.

6. Beta-Phase

Die App befindet sich derzeit in der Beta-Phase. Das bedeutet:

• Funktionen können unvollständig sein oder jederzeit ohne Ankündigung geändert oder entfernt werden.
• Es können Ausfälle, Datenverluste oder andere Probleme auftreten.
• Wir können zusätzliche Feedback- und Nutzungsdaten zur Verbesserung der App erheben.
• Der Beta-Zugang kann jederzeit nach unserem Ermessen widerrufen werden.

Wir empfehlen dringend, die App während der Beta-Phase nicht für kritische Zwecke zu nutzen.

7. Geistiges Eigentum

Alle Inhalte, Marken, Designelemente und Codes innerhalb der App und der Website - mit Ausnahme der Nutzerinhalte - sind unser Eigentum oder wurden uns lizenziert. Eine Vervielfältigung, Reproduktion, Verbreitung oder die Erstellung abgeleiteter Werke ist ohne unsere vorherige schriftliche Zustimmung nicht gestattet.

8. Datenschutz

Die Nutzung der App unterliegt zudem unserer Datenschutzerklärung, die durch Verweis Bestandteil dieser AGB ist.

9. Haftungsausschluss

Die App wird „wie gesehen" und „wie verfügbar" ohne jegliche ausdrückliche oder stillschweigende Garantien bereitgestellt. Wir garantieren nicht, dass die App fehlerfrei oder kontinuierlich verfügbar ist.

10. Haftungsbeschränkung

Im größtmöglichen gesetzlich zulässigen Umfang haften wir nicht für indirekte, zufällige, besondere, Folge- oder Strafschäden, die aus der Nutzung oder der Unmöglichkeit der Nutzung der App entstehen. Unsere Gesamthaftung dir gegenüber für etwaige Ansprüche übersteigt nicht 50 €.

Zwingende Verbraucherrechte nach deutschem und EU-Recht bleiben unberührt.

11. Kündigung

Wir können deinen Zugang zur App jederzeit, mit oder ohne Grund, sperren oder kündigen. Du kannst die Nutzung der App jederzeit einstellen und die Kontolöschung über Einstellungen → Konto löschen oder per E-Mail an hey@getunmask.org beantragen.

12. Änderungen dieser AGB

Wir können diese AGB von Zeit zu Zeit aktualisieren. Über wesentliche Änderungen informieren wir dich per App-Benachrichtigung oder E-Mail. Die fortgesetzte Nutzung der App nach Veröffentlichung von Änderungen gilt als Zustimmung zu den aktualisierten AGB.

13. Anwendbares Recht und Gerichtsstand

Diese AGB unterliegen dem Recht von unter Ausschluss der kollisionsrechtlichen Bestimmungen. Ausschließlicher Gerichtsstand ist , soweit gesetzlich zulässig. Zwingende Verbraucherschutzvorschriften des Wohnsitzlandes bleiben unberührt.
